Welcome to DialX

These Terms of Use ("Terms") govern your use of the DialX Android application ("DialX", the "App", "we", "us", or "our") provided by Avadhkumar ("Developer"). By downloading, installing, or using DialX, you agree to these Terms. If you do not agree with them, please do not use the App.

1. Eligibility

You must be legally permitted to use the App in your country or region. By using DialX, you represent that your use of the App complies with applicable laws, regulations, and the terms of your mobile carrier and device services.

2. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use DialX on Android devices that you own or control for lawful personal use.

You may not copy, redistribute, sell, rent, sublicense, or otherwise exploit the App or any part of it except where permitted by applicable law.

3. Use of DialX

DialX provides phone and dialer functionality, including calling, contact and call history management, and customization features. Some features depend on your device, Android version, carrier, permissions, network availability, or the App being set as the default phone application.

You are responsible for how you use DialX and for any communications or actions made through your device.

4. Acceptable Use

You agree not to use DialX to:

• violate any applicable law or regulation;
• commit fraud or engage in abusive, harmful, or unlawful activity;
• harass, threaten, impersonate, or unlawfully interfere with another person;
• interfere with, damage, or attempt to compromise the App or its services; or
• reverse engineer, decompile, modify, or create derivative works of the App, except where such activity cannot lawfully be restricted.

5. Premium Features and Subscriptions

Certain DialX features may require a paid subscription. Subscriptions are purchased and managed through Google Play.

• Prices, plans, billing periods, and available features may change over time.
• Subscriptions renew automatically unless cancelled through your Google Play account before the applicable renewal date.
• Cancellation prevents future renewals but does not normally end the current billing period early.
• Refunds are handled in accordance with Google Play's applicable policies and terms.
• Premium features may be changed, replaced, suspended, or discontinued as the App evolves.

6. Advertising and Rewards

DialX may display advertisements, including optional advertisements that may provide in-app rewards or temporary access to certain features when completed. Availability, eligibility, and reward conditions may vary and may change without notice.

Rewards have no cash value, cannot be transferred or sold, and may not be redeemed outside the App. We may limit, suspend, or withdraw rewards where reasonably necessary to prevent abuse, fraud, or misuse.

7. Third-Party Services

DialX may depend on third-party services, including services provided through Google Play and other service providers. Those services may be subject to their own terms and policies. We are not responsible for the availability, content, or operation of third-party services that are outside our control.

8. Intellectual Property

DialX, including its software, design, user interface, branding, logos, icons, graphics, and other materials provided by us, is owned by or licensed to the Developer and is protected by applicable intellectual property laws.

These Terms do not transfer ownership of any intellectual property to you. Except for the license expressly granted in these Terms, all rights are reserved by the Developer and its licensors.

9. Updates and Availability

We may release updates, security fixes, bug fixes, and new features from time to time. Some updates may be necessary for continued use of certain features.

We may modify, suspend, or discontinue any part of DialX at any time. We will make reasonable efforts to maintain the App, but we do not guarantee that it will always be available or compatible with every Android device, operating system version, manufacturer configuration, carrier, or network.

10. Emergency Calls

DialX is not a replacement for emergency services. Emergency calling depends on your device, SIM or eSIM, carrier, network, Android, and other system services that are outside our control.

We do not guarantee that emergency calls will always be available or complete successfully. You should not rely solely on DialX when contacting emergency services.

11. Disclaimer

To the fullest extent permitted by applicable law, DialX is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory.

We do not guarantee that DialX will always be uninterrupted, error-free, secure, accurate, or compatible with your particular device or network.

12. Limitation of Liability

To the fullest extent permitted by applicable law, the Developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, DialX.

Nothing in these Terms limits any liability or rights that cannot lawfully be excluded or limited under applicable law.

13. Termination

You may stop using DialX at any time by uninstalling the App. We may suspend or terminate access to features or services if you materially violate these Terms, misuse the App, or where necessary to comply with applicable law or protect the App and its users.

14. Privacy

Your use of DialX is also governed by our Privacy Policy, which explains how information is handled in connection with the App.

15. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or DialX will be subject to the jurisdiction of the courts of India, except where applicable law provides otherwise.

16. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of DialX after updated Terms become effective means you accept the revised Terms, to the extent permitted by applicable law.
